At INVSTY-Royal LePage Real Estate Services ("Royal LePage"), we are committed to protecting the privacy of our clients, employees, and brokers in Toronto, Ontario. We understand the importance of maintaining the confidentiality, accuracy, and security of personal information, and have adopted the following Privacy Policy to ensure that we continue to meet our commitment to your privacy.
At Royal LePage, we provide a variety of real estate services to the public, including but not limited to: real estate brokerage services, real estate agency services, real estate advisory services, home leasing, property management, and real estate brokerage franchising services. In the course of providing these services, we may collect personal information about our clients, employees, and brokers with their consent.
"Personal information" refers to information about an identifiable individual, including but not limited to: name, home address, age, income, credit history, credit card information, personal preferences, and other information about their family. Personal information does not include the name, title, business address, or telephone number of an employee of an organization.
Our Privacy Policy is based on and complies with Canada's Personal Information Protection and Electronic Documents Act (PIPEDA) and the Ten Privacy Principles outlined in the Canadian Standards Association Model Code for the Protection of Personal Privacy. The following ten principles govern our actions as they relate to the use of personal information:
Principle 1: Accountability Royal LePage is accountable for all personal information in its possession or custody, including personal information disclosed to third parties for the purposes of providing services requested by you.
Principle 2: Identifying Purposes We will inform you of the purposes for which we are collecting any personal information, before or at the time the information is collected.
Principle 3: Consent We will obtain your consent before or when we collect, use, or disclose your personal information. Consent can be express, implied, or given through an authorized representative. You may withdraw your consent at any time, subject to legal or contractual restrictions and reasonable notice.
Principle 4: Limiting Collection We will only collect personal information that is necessary for the purposes identified to you. We will collect personal information by fair and lawful means.
Principle 5: Limiting Use, Disclosure, and Retention We will only use or disclose your personal information for the purposes for which it was collected, unless you have otherwise consented, or when it is required or permitted by law. We will retain your personal information only as long as necessary to fulfill the identified purposes or as required by law.
Principle 6: Accuracy We will take reasonable steps to ensure that your personal information is accurate, complete, and up-to-date.
Principle 7: Safeguarding Personal Information We have implemented appropriate physical, technical, and organizational measures to protect your personal information from unauthorized access, use, or disclosure.
Principle 8: Openness We will make information about our policies and practices regarding the management of personal information readily available to you.
Principle 9: Access You have the right to access your personal information in our possession or custody, and to request correction of any errors. We will respond to your request within a reasonable time and at minimal or no cost to you.
Principle 10: Addressing Complaints If you have any questions, concerns, or complaints about our handling of your personal information, please contact our Chief Privacy Officer. We will investigate and respond to your concerns in a timely and appropriate manner.
Royal LePage collects and uses Personal Information to provide clients with real estate products and services, such as information needed to sell or rent properties, locate and qualify properties for buyers, assess independent broker applicants, and ensure client satisfaction. Royal LePage may also use Personal Information to update clients about its services and offer additional products or services that may be of interest. In some cases, Royal LePage may be required to collect a client's Social Insurance Number due to obligations under the Income Tax Act. When clients visit Royal LePage websites, personally identifiable information is only collected if it is provided by the client, and this information is kept confidential. Royal LePage may use aggregated data in any way it determines appropriate, but this Privacy Policy does not apply to data from which a specific individual cannot be identified.
Royal LePage uses Personal Information for three main purposes: to communicate with clients and provide products and services, for inclusion in documentation related to real estate transactions, and to monitor and report on the level of service provided to ensure client satisfaction. Personal Information will only be used for the purposes disclosed to clients, and clients will be notified and asked for consent if Royal LePage wishes to use their information for a different purpose.
Royal LePage is required to keep Personal Information confidential except in certain circumstances, including when authorized by the client, when required by law, or when permitted by law. In some cases, if a client does not consent to the use or disclosure of certain Personal Information, Royal LePage may be unable to provide all or part of the requested services. Royal LePage may be required to disclose certain information to government authorities or under court orders, but will only provide the specific information requested and will ensure that the authorities have legitimate grounds for the request. Royal LePage is also legally permitted to disclose Personal Information without consent in certain situations, such as for debt collection, medical emergencies, or suspicion of illegal activities.
Royal LePage employees only have access to sensitive Personal Information if they have a legitimate reason for accessing it and are required to follow all applicable laws and regulations, including the Privacy Policy. Royal LePage may also share Personal Information with its affiliates and agents, who are also required to maintain the confidentiality of the information and use it only for the purposes it was shared. Royal LePage may also share Personal Information with service providers who assist with its business operations, such as IT and marketing services. In these cases, Royal LePage ensures that the service providers are bound by appropriate confidentiality agreements.
Royal LePage takes steps to protect the security of Personal Information, including physical, electronic, and procedural safeguards. Personal Information is stored in secure locations and on secure servers, and access is limited to authorized personnel. Royal LePage also uses encryption and other security measures to protect Personal Information transmitted online.
Clients have the right to access their Personal Information and request changes to any inaccuracies. To make a request, clients should contact Royal LePage's Privacy Officer. Royal LePage will respond to requests within a reasonable time and may require proof of identity before fulfilling the request. If a client has any concerns about the handling of their Personal Information, they can also contact the Privacy Officer to resolve the issue.
